    Military attorney and author, Major Evan R.     Although estimates vary, approximately 20% of combat veterans suffer invisible wounds of war including Posttraumatic Stress Disorder (PTSD), a figure that increases dramatically with the number and length of repeated deployments.[1] In less than four years, over 88 Veterans Treatment Courts (VTCs) have emerged across the Nation in recognition that traditional confinement options often fail to treat the underlying mental health needs of war-traumatized veterans.[2] These special court dockets, which combine treatment from the federal Department of Veterans Affairs, veterans mentors and an interdisciplinary treatment team led by a judge with special experience and training, are the most comprehensive programs in a line of innovations that recognize the societal cost of criminalizing mental illness. These costs include aggravation of the mental condition in confinement and the increased likelihood of repeat offenses once released. Other notable trends to prevent a public health epidemic of veteran crime include police patrols with veteran counselors in major cities like Chicago and Los Angeles,[3] special therapeutic dormitories in jails just for veterans within the Florida Department of Corrections,[4] requirements to inquire about veteran status at criminal sentencing hearings in California and Minnesota,[5] and the ability of PTSD-afflicted veterans to list the diagnosis on their drivers? licenses in Georgia with the goal of de-escalating conflicts with law enforcement officers during traffic stops.[6]

    Ironically, while many civilian agencies have modified the criminal justice system to respond to the treatment needs of veterans based on trauma they suffered during active duty military service, military offenders with psychological wounds of war receive far less favorable consideration while serving, even though these offenders are closer to the source of the trauma. Although a 2010 study of 77,881 deployed Marines revealed an 11 times greater likelihood of serious criminal conduct for Marines diagnosed with PTSD,[7] and a 2012 Army report emphasizes how military leaders ?cannot deal with health or discipline in isolation,?[8] military judges and juries are prohibited from ordering probation that would allow for mental health treatment. Instead, the court-martial system considers suspension of sentences as a matter of clemency reserved only for commanding generals who may have only a few minutes to peruse volumes of court-martial testimony and records. Studies of military clemency in the Army and the Navy in 2007 revealed a trend in which commanders have granted clemency in less than five percent of cases, with suspensions of confinement and punitive discharges occurring far less frequently.[9]

    For offenders with mental illness who increasingly populate courts-martial, the punitive discharge can become lethal. According to the military?s own sentencing guides, this form of punishment, with no civilian counterpart, ?deprives one of substantially all benefits administered by the Department of Veterans Affairs.?[10] Recognizing how the court-martial system can prevent all hope of future VA treatment for combat veterans who are most needy of continued care, Army lawyer Major Evan R. Seamone, a veteran of Operation Iraqi Freedom, has proposed a method to suspend the sentences of active duty offenders, provide them treatment through local VTCs, and preserve the VA benefits they earned through their service to the Nation. His book-length article examines historical lessons from rehabilitation efforts for offenders in past wars and incorporates them into a series of practical tools for use by military commanders, military and civilian attorneys, and judges. By providing model sentencing guides, jury instructions and pretrial agreement terms that consider mental conditions, eligibility, treatment, and funding mechanisms, Major Seamone demonstrates that the proposal can be accomplished today, incorporating civilian treatment innovations without the need to change a single law.

    Major Evan R. Seamone has served as a military prosecutor, defense attorney, capital litigation attorney, and Chief of Military Justice.     The VA?s recent decision to extend the deadline for veterans to file for disability benefits related to Gulf War illnesses will help many afflicted service members to obtain vital compensation, Tampa disability benefits lawyer Lawrence Disparti said today.

    The U.S. Department of Veterans Affairs? original deadline expired December 31. However, the VA recently announced that Gulf War veterans will now have until Dec. 31, 2016, to apply for disability benefits. Family members of disabled servicemen and women can also apply for survivors? benefits until that time, the VA said.

    ?More than 700,000 military personnel were deployed in the early 1990s to serve our country in Operations Desert Storm and Desert Shield. Sadly, many of these veterans developed debilitating illnesses as a result of their service,? said Disparti, whose Florida disability benefits law firm, the Disparti Law Group, P.A., helps veterans with disability claims.

    ?This new deadline will help at-risk people who may not be ill now, but who could develop illnesses within the next five years,? he said.

    According to the VA, Gulf War veterans may have been exposed to substances that have been linked to services-connected illnesses. These include burn pits, chemical and biological warfare agents, depleted uranium, oil well fires, smoke, petroleum, pesticides, pyridostigmine bromide (an anti-nerve agent) and vaccinations for anthrax and botulinim toxoid.

    The VA has listed some ?presumptive illnesses? that do not require proof to qualify for benefits, such as chronic fatigue syndrome, fibromyalgia, functional gastrointestinal disorders and some undiagnosed illnesses such as cardiovascular problems or abnormal weight loss.

    Non-presumptive ailments ? those illnesses which have not been officially recognized as related to Gulf War service ? may also be compensable but require additional substantiation, Disparti said.

    That?s where disabled veterans can run into trouble, according to the Tampa veterans? disability benefits attorney.

    ?Filing veterans? disability claims is not necessarily a simple process,? Disparti said. ?There needs to be strong supporting medical information and other evidence. Many claims are rejected initially and must be appealed. It can be exhausting and confusing for veterans with significant physical and mental health issues stemming from Gulf War service.?

    The amount of disability compensation for veterans varies based on the severity of the service-connected illness. The VA determines how much money a veteran may receive on a disability scale of 1 to 100. Individuals with a rating of 100 are considered the most seriously disabled and are eligible for the most compensation.

    Gulf War veterans who seek disability benefits from the VA can benefit from speaking with an experienced attorney before starting the claims process, Disparti said.

    Delivering the Friday night keynote address will be attorney Jan R. Schlichtmann, who became famous during the 1980s as a result of his lawsuit alleging that chemicals from several companies had contaminated drinking water in a town north of Boston. This case served as the basis for the book, and later the film, A Civil Action .

    Also participating in the conference as panelists will be Chief Justice Carol W. Hunstein of the Supreme Court of Georgia; Joyce Tischler, co-founder of the Animal Legal Defense Fund; and Tom Rawlings, Guatemala field office director for the International Justice Mission, to name a few.

    “WIPI is an entirely student-run public interest law conference that seeks to bring together both practitioners and students to discuss real issues confronting attorneys and others working in the field of public interest,” third-year law student and conference director Karen S. Bemis said.

    The full conference agenda includes panels on the impact of college student debt on the economy, the fallout from budget cuts in the area of domestic violence prosecution, the constitutionality of the death penalty, the sustainability of animal farming, and the advantages and disadvantages of solo practices as well as alternative public interest careers.

    The school’s Equal Justice Foundation will also host its annual auction as part of the conference to help raise money for Georgia Law students who choose to take unpaid or low paying public interest legal positions during the summer. The auction will be held March 2 at the Melting Point following the keynote address.

    Drawing upon the work of four bold filmmakers, we will participate in a dialog about what we can do as artists and individuals to create a sea change in the social and political climate currently faced by undocumented youth and adults, and to challenge the dominant frame of criminality and punishment.

    Between films we will discuss with these directors the intersection of creativity and activism, the role of independently produced media, community challenges, and tactics for grassroots resistance. Perhaps most importantly, we will gain a deeper understanding of the actual experience of being undocumented from the directors and audience members whose daily realities include a deficit of rights and opportunities.

    In 1992, Sam and Elida Mejia left Guatemala during a violent civil war and brought their one-year old son, Gilbert, to California. The Mejia's settled in the Bay Area, and for the past 17 years they have worked multiple jobs to support their family, paid their taxes, and saved enough to buy a home. They had two more children, Helen and Dulce, who are both U.S. citizens. Two years ago, immigration agents stormed the Mejia's house looking for someone who didn't live there. Sam, Elida, and Gilbert were all undocumented and became deeply entangled in the U.S. immigration system.

    "Sin País" begins two weeks before Sam and Elida's scheduled deportation date. After a passionate fight to keep the family together, Sam and Elida are deported and take Dulce with them back to Guatemala.

    With intimate access and striking imagery, "Sin País" explores the complexities of the Mejia's new reality of a separated family-parents without their children, and children without their parents.
